Terms of Service

1. Acceptance of Terms

By creating an account or using JG Sheet Music & More (the "Service"), operated by Jeremy Gaisin ("we", "us"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Service.

2. Beta status; no warranty

The Service is currently in open beta. Features may change, break, or be removed without notice. The Service is provided "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We make no guarantee that the Service will be uninterrupted, secure, or error-free.

Back up your sheets locally — do not rely on the Service as your only copy.

2a. Free tier limits

The free tier allows up to 20 sheets per account during the open beta. Per-file size cap: 25 MB. We may change tier limits or introduce paid tiers at any time. Existing accounts will get reasonable notice before any restriction change.

3. Eligibility & account responsibility

You must be at least 13 years old to use the Service. By signing up you represent and warrant that you are at least 13 years old and that the information you provide is accurate.

You are responsible for: (a) keeping your password secret, (b) all activity that occurs under your account, (c) immediately notifying us at apps@ratzonorchestra.com of any unauthorized access.

4. User content — your responsibility

"User Content" means any sheet music, scans, photos, lyrics, recordings, setlists, comments, or other content you upload to the Service.

You retain ownership of your User Content. By uploading, you grant us a worldwide, non-exclusive, royalty-free license to store, copy, display, and transmit that content solely for the purpose of operating the Service for you (and any bandmates you share with).

You represent and warrant that for everything you upload: (a) you own the work or have a valid license to use, store, and share it; (b) it does not infringe any third-party copyright, trademark, publicity, or privacy right; (c) it does not violate any applicable law.

The Service is a tool. We do not pre-screen User Content. We are not the publisher of and have no obligation to monitor User Content.

5. Prohibited content and conduct

You agree NOT to upload, store, or transmit content that: infringes intellectual property rights you don't own; depicts illegal activity; contains malware; is defamatory or harassing; contains sexual content involving minors (we will report to authorities); violates any applicable law. You agree NOT to attempt to: access other users' content without authorization; reverse engineer the Service; interfere with the Service's operation; resell or commercialize the Service.

6. DMCA takedown

If you believe content on the Service infringes your copyright, send a DMCA notice to apps@ratzonorchestra.com with: (a) identification of the copyrighted work, (b) identification of the infringing material with URL, (c) your contact info, (d) a statement that you have good-faith belief the use is not authorized, (e) a statement under penalty of perjury that your notice is accurate and you are authorized to act, (f) physical or electronic signature. Repeat infringers will have their accounts terminated.

7. Termination

We may suspend or terminate your account at any time, with or without notice, including for violation of these Terms. You may cancel anytime by emailing apps@ratzonorchestra.com. On termination we may delete your User Content; export it before canceling.

8. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangibles, arising from your use of the Service, even if we have been advised of the possibility of such damages.

Our total cumulative liability to you for all claims relating to the Service shall not exceed the amount you have paid us in the past twelve months, or USD $50, whichever is greater. (Because the beta is free, this means USD $50.)

9. Indemnification

You agree to defend, indemnify, and hold us harmless from any claim, demand, loss, damage, cost, or expense (including reasonable attorneys' fees) arising from: (a) your use of the Service, (b) your User Content, (c) your violation of these Terms, (d) your violation of any third-party right.

10. Changes to these Terms

We may update these Terms. We'll post the new version here with an updated "Last updated" date and, for material changes, notify you by email. Continued use after changes means you accept the new Terms.

11. Governing law

These Terms are governed by the laws of the State of New Jersey, USA, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in New Jersey.

12. Severability; entire agreement

If any provision is found unenforceable, the rest remains in effect. These Terms together with the Privacy Policy constitute the entire agreement between you and us regarding the Service.
