1. About this service

JG Music Tools (the "Service") at ratzonorchestra.com, jeremygaisin.com, and jeremyashermusic.com is operated by Jeremy Gaisin as a free, best-effort music tool for bands, leaders, and musicians. The Service is provided "as is" without warranty of any kind.

2. Your content, your responsibility

You are solely responsible for everything you upload.

By uploading sheet music, audio, images, lyrics, chord charts, notes, recordings, or any other content (your "Content") to the Service, you represent and warrant that:

You own the Content, OR you have written permission from the copyright holder to upload and use it.
Your Content does not infringe any copyright, trademark, trade secret, right of publicity, privacy right, or other proprietary right of any party.
Your Content does not contain defamatory, obscene, hateful, harassing, threatening, or unlawful material.
You will not upload software viruses or any malicious code.

You retain all rights to your Content. You grant Jeremy Gaisin a limited, revocable license to store, display, and transmit your Content solely to provide the Service to you and the band members you authorize.

3. Indemnification

You agree to indemnify, defend, and hold harmless Jeremy Gaisin, the Service, and all related parties from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from or relate to: (a) your Content; (b) your use of the Service; (c) your violation of these Terms; or (d) your violation of any rights of any third party. This obligation survives termination of your account.

4. No warranty & limitation of liability

The Service is provided "AS IS" and "AS AVAILABLE". Jeremy Gaisin makes no warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, error-free, or that data will not be lost. Do not rely on the Service as your only copy of important content — keep your own backups.

To the maximum extent permitted by law, Jeremy Gaisin's total cumulative liability arising out of or in connection with the Service shall not exceed one hundred US dollars ($100), or the amount you paid for the Service in the prior twelve months, whichever is greater. In no event shall Jeremy Gaisin be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages.

5. Access to Jeremy Gaisin's sheet music library

The sheet music catalog at ratzonorchestra.com/sheets/ and equivalent paths on the other sites is the personal library of Jeremy Gaisin. Signing up does not grant access to that library. Public users may only browse, broadcast, or share their own uploaded sheets unless Jeremy explicitly grants them additional access on a per-user basis.

6. Account approval & usage limits

New self-signups default to pending status and may not log in until approved. Free accounts may upload up to 20 sheets and broadcast up to 15 sheets per setlist. Anonymous (no signup) usage is limited to 10 sheets on-device and 5 per broadcast. Paid tiers, if introduced, will have their own limits. Jeremy may change limits at any time.

7. Termination

Jeremy may suspend or delete any account or any Content at any time, for any reason or no reason, with or without notice. Upon termination, your right to use the Service immediately ceases.

8. Governing law & venue

These Terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in New York County, New York, and you consent to personal jurisdiction in those courts.

9. Changes to these Terms

Jeremy may update these Terms at any time. Your continued use of the Service after a change constitutes acceptance of the updated Terms. The current version is always available at /app/agree.php.

10. Age

You must be at least 13 years old to use the Service. If you are under 18, you confirm that a parent or guardian has reviewed and approved these Terms on your behalf.
